These Terms and Conditions ("Terms") govern your use of the ProjectFund platform operated by NSIT Services Pty LTD (ABN 75 122 740 121) ("we", "us", "our"), a company incorporated in New South Wales, Australia. By accessing this website or submitting an application, you agree to these Terms.

1. Platform Overview

ProjectFund is a funding facilitation platform that connects project owners with investors and funding sources globally. We do not provide financial advice and are not a registered financial services provider under the Corporations Act 2001 (Cth).

2. Eligibility

To use this platform you must:

  • Be a legally registered business entity
  • Have a project with minimum funding requirements of $5,000,000 USD
  • Have authority to represent the company and project
  • Comply with all applicable laws and regulations in your jurisdiction

3. Application Process

Submitting an application does not guarantee funding. All applications are subject to pre-qualification, due diligence, and investor appetite. We reserve the right to decline any application at our discretion.

4. Confidentiality

All project information shared from Step 3 onwards is governed by a Non-Disclosure Agreement (NDA). Any information shared prior to NDA execution should not include highly sensitive or proprietary information.

5. Fees

Facilitator and intermediary fees apply to successful funding arrangements. These fees are disclosed in detail after pre-qualification and NDA execution. No upfront fees are charged for the pre-qualification process.

6. Accuracy of Information

You represent that all information provided in your application is accurate, complete, and not misleading. Provision of false information may result in immediate termination of your application and may constitute fraud under applicable law.

7. Limitation of Liability

To the maximum extent permitted by law, NSIT Services Pty LTD shall not be liable for any indirect, consequential, or incidental damages arising from use of this platform or failure to secure funding.

8. Intellectual Property

All content on this website, including text, graphics, and brand materials, is owned by NSIT Services Pty LTD and protected by copyright. You may not reproduce or use our content without prior written consent.

9. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of New South Wales.

10. Changes to Terms

We reserve the right to update these Terms at any time. Continued use of the platform after changes constitutes acceptance of the revised Terms.
